Salvatore Gangemi was quoted in the August 25th edition of The National Law Journal regarding the whistleblower protections of the newly-enacted Consumer Product Safety Improvement Act. The new law bans lead and other toxic materials from being used in toys and other children's products. In addition, the law contains a whistleblower provision that protects employees who blow the whistle on employers who violate the law. Without such protection, the new law would be rendered a "toothless tiger," said Gangemi.

The firm obtained a final judgment in the amount of $234,415.78 in Pachter v. Bernard Hodes Group, Inc., (United States District Court, Southern District of New York), a case involving unlawful deductions from commissions. The court found that over a period of six years, the employer unlawfully deducted $153,817.51 from the plaintiff's commissions. In addition to awarding the plaintiff the amounts unlawfully deducted, the court awarded prejudgment interest in the amount of $80,598.27.

In an employment case handled by the firm involving Article 6 of the New York Labor Law, Judge Robert P. Patterson, Jr. of the United States District Court for the Southern District of New York granted summary judgment in plaintiff's favor on the following issues: (1) Whether an executive employee is entitled to the protection of Labor Law §193, prohibiting the deduction of expenses from compensation; and (2) Whether the defendant violated Labor Law §193 when it subtracted from the plaintiff's compensation certain business and other expenses. The Court ruled that executives are, in fact, protected by section 193 and that the manner in which the employer deducted certain costs, losses and expenses from the plaintiff's compensation violated New York law. Pachter v. Bernard Hodes Group, Inc., 03 Civ. 10239 (RPP), United States District Court, Southern District of New York.

Judge Katharine S. Hayden of the United States District Court for the District of New Jersey denies Sylvester Stallone's motion to dismiss the complaint filed by Chuck Wepner. Wepner's complaint alleges that Stallone violated Wepner's right of publicity based upon Stallone's alleged unauthorized use of Wepner's name in connection with the Rocky franchise. The firm is serving as co-counsel on this matter.
